Welcome to Audiolog. These Terms of Service ("Terms") govern your access to and use of the Audiolog mobile application (the "App") and related services (collectively, the "Services"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms within the App and updating the "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the modified Terms.
You must be at least 13 years old (or 16 in the European Union) to use our Services. If you are under 18, you represent that you have your parent or guardian's permission to use the Services. By using the Services, you represent and warrant that you meet these requirements.
To use certain features of the App, you must create an account using Google Sign-In or Apple Sign-In. You agree to:
You may not create an account using false information or on behalf of someone other than yourself. We reserve the right to suspend or terminate accounts that violate these Terms.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal device solely for your personal, non-commercial use.
You retain all ownership rights to the content you create, upload, or log in the App, including your music listening logs, tags, and other data ("User Content"). By using our Services, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and process your User Content solely for the purpose of providing and improving our Services.

While we implement regular backup procedures, you are responsible for maintaining your own backup of any important data. We are not responsible for any loss or corruption of your data.
Our App integrates with third-party services including Spotify and Last.fm. Your use of these integrations is subject to their respective terms of service and privacy policies. We are not responsible for:
By connecting third-party accounts to Audiolog, you authorize us to access information from those services as permitted by their APIs and your authorization.

The App offers both free and premium subscription tiers. Premium features may include unlimited calendar history access and additional functionality. Subscription terms, pricing, and available features are subject to change.
All payments are processed through Apple App Store or Google Play Store. Your subscription is subject to the payment terms and policies of your respective app store. We do not store or process your payment information directly.
You may cancel your subscription at any time through your app store account settings. Cancellation will take effect at the end of your current billing period. Refunds are handled according to Apple's and Google's refund policies. We do not provide refunds directly.
We reserve the right to modify subscription pricing at any time. Price changes will not affect your current subscription period but will apply to subsequent renewal periods. You will be notified of any price changes in advance.
The Services, including the App, its original content, features, functionality, and all related intellectual property rights, are owned by Audiolog and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
The Audiolog name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Audiolog. You may not use such marks without our prior written permission.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AUDIOLOG, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICES EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
You agree to defend, indemnify, and hold harmless Audiolog and its affiliates, officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
We are committed to protecting your privacy and data security. Our collection, use, and disclosure of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to our collection and use of your data as described in the Privacy Policy.
While we implement reasonable security measures, no system is completely secure. You acknowledge that you provide your information at your own risk.
You may terminate your account at any time by deleting your account through the App's settings or by contacting us at support@audiolog.net. Upon termination, your right to use the Services will immediately cease.
We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, with or without notice, for any reason including but not limited to:
Upon termination, all licenses and rights granted to you will immediately cease. We may delete your account and User Content, though we may retain certain information as required by law or for legitimate business purposes. Sections of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Before filing a claim, you agree to contact us at support@audiolog.net and attempt to resolve the dispute informally. We will attempt to resolve the dispute informally by contacting you via email.
If we cannot resolve a dispute informally, any dispute arising out of or relating to these Terms or the Services will be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
YOU AND AUDIOLOG AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Audiolog operates, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in that jurisdiction, and you consent to personal jurisdiction and venue therein.
We reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time, with or without notice, for any reason. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Audiolog regarding the Services and supersede all prior agreements and understandings.
If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent possible, and the remaining provisions will remain in full force and effect.
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section shall be void.
We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, natural disasters, or internet service provider failures.
